Scope and definitions

These general sales conditions and the general conditions for the delivery of services apply to all orders placed with Digital Assistance bv, IJskelderstraat 87, 2660 Antwerp-Hoboken, Belgium, registered under company number BE0757620280.

These conditions govern the relationship between the service provider / seller and the customer. The customer may be a natural person or a legal entity ordering products and/or services. A consumer is a natural person acting outside their trade, business, craft or profession.

Offers and orders

To place an order, the customer selects the requested products and/or services, enters the requested details, checks the order and completes payment. After payment confirmation, Digital Assistance sends an order summary including the order number, the products and/or services ordered, the price, these conditions or a link to them and an indication of the expected delivery or execution date.

Digital Assistance may suspend, cancel or refuse an order if the information provided by the customer is clearly incorrect or incomplete, or if there is a dispute regarding payment for a previous order. If the customer cancels an accepted order, a cancellation fee equal to 30% of the order price may be charged, except in cases of force majeure.

Prices

Prices are stated in euro. VAT is included for private customers and excluded for business customers unless stated otherwise. Any VAT increase, new tax or delivery charge may be charged according to the applicable rules and the method and place of delivery.

Delivery periods

Delivery and execution periods are indicative unless expressly accepted in writing. A delay does not automatically entitle the customer to compensation, cancellation or suspension, unless mandatory law provides otherwise.

Retention of title

Delivered goods remain the property of Digital Assistance until full payment has been received. Until full payment, the customer may not pledge, transfer or otherwise use the goods as security.

Right of withdrawal

Where legally applicable, consumers ordering at a distance have a withdrawal period of 14 calendar days. For products, this period starts on the day of delivery or when the goods are made available at the agreed collection point. For services, the period starts on the date of conclusion of the agreement. If service delivery starts early at the consumer’s explicit request, the withdrawal right may be lost to the extent permitted by law.

Cancellation

If the customer does not qualify for the legal right of withdrawal and still wishes to cancel an order, Digital Assistance will inform the customer of the procedure to follow. If no advance payment was made, a cancellation fee of 30% of the price of the cancelled products and/or services may be charged.

Delivery and performance

Orders are delivered or performed only after full payment, unless otherwise agreed in writing. Ownership and risk transfer according to the applicable conditions and legal rules.

Availability

Products are offered subject to availability. If one or more products become unavailable after payment, Digital Assistance will inform the customer as soon as possible and offer a refund, a change to the order or delayed delivery as soon as the relevant products are back in stock.

Receipt and complaints

The customer must check the order form and the conformity of delivered or collected goods. Complaints regarding delivered goods or services must be submitted in writing within 5 working days after delivery, collection or the event giving rise to the complaint. If a complaint is justified, Digital Assistance may replace the product or service or refund the relevant price.

Intellectual property

Information, logos, drawings, trademarks, models, slogans and visual identity elements accessible via the website or catalog are protected by intellectual property rights. Unless expressly agreed otherwise in writing, no transfer of such rights is included.

Warranty, liability and force majeure

The legal warranty rules apply where required by law. Digital Assistance is not liable for indirect damage except where mandatory law provides otherwise. In cases of force majeure, Digital Assistance may suspend or cancel performance without additional liability.

Applicable law and jurisdiction

These conditions are governed by Belgian law. In the event of disputes, the competent courts of the registered office of Digital Assistance apply, subject to mandatory consumer protection rules.
